What information do I need to know about someone who illegally cashed my deceased father's check?

A person not supposed to be handling my deceased father's business has taken matters into their own hands and cashed his last check. I contacted his last job to see if the check could be sent to me, his beneficiary, and they said it had been already cashed, probably illegally at some liquor store in the neighborhood. What can I do at this point?

Ask for a copy of the check, front & back and file a police report.

Who did the company release the check to? If you have their name and address, file a police report. They'll take it from there.

get a lawyer. and get ready to sue.... especially if your father died intestate(that is: without a will)

You could see if they can still stop pay the check, and you can also ask for a copy of the check when it comes back to them, so you can find out who cashed it (or you can have an analyst look at the signature) and then proceed with fraud charges against the suspect person... More

1. Report it to the police. 2. Get front and back copies of the check. 3. Whoever cashed the check for the thief is liable for the money. 4. This is a criminal case, you shouldn't have to sue.

The company still owes you the check. They issued it to the wrong person and it is their money he stole not yours. Let them file the criminal complaint but give you what they owe you. You never had possession of the money so was stolen from company through fraud not from you.
