I have been off work sick for 4 months and don't know my rights if my job is terminated?

I have had a disability since before joining my present employers where I've worked over 9 years. In May this year it took a turn for the worse and there don't appear to be any chances of my condition improving. My employers (in UK) are currently reducing staff numbers and there have been early redundancy packages given to employees recently which were not sickness related.I have tried to get advice about ill health retirement (I am over 50) but have also been told that being made redundant is a better option, although no one seems to really understand the processes. Its a bit scary and very confusing - anyone had any similar experiences?

I think that because of the large amount of money involved you would be best to get legal advice here.

they cannot terminate your contract unless they can prove that you are not genuinely sick. As you are classed as disabled they have to act within the guidelines of the disability discrimination act. You might want to enquire about vountary redundancy and contact your trustees regarding early retirement.
