Can my last employer hold my last paycheck?
I am an owner-operator of an 18-wheeler. I quit my job in Ohio three weeks ago to take a company driver position closer to home in Arkansas. My last employer is holding my last paycheck claiming that they are holding it till they have all employees quarterly taxes finished. This is causing problems with me paying my bills. Can they do this? If not, what should I do?

Talk to someone from Ohio's department of labor. It is determined by state law. The law in Ohio is: If employee quits: first of the month for wages earned in the first half of prior month; fifteenth of the month for wages earned in second half of prior month. (Ohio Rev. Code Ann. § 4113.15.)

Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment, don't believe Ohio is one of these states.
