Why do some private universities use Affirmative Action..........but others don't?

I know affirmative action is required among all colleges in the PUBLIC sector............ (in most states)........... but in the private sector; it varies. Some universities/colleges use affirmative action.........while others don't. Harvard & Yale use affirmative action. John Carroll University uses affirmative action. but other private schools do not use it. like Case Western Reserve, Chancellor University, Notre Dame College, Ursuline College, etc. Are private schools required to use affirmative action? Do some schools just have their board of directors decide whether they wish to participate in affirmative action? How does that work?
