Can employers hold post operative care against an employee?

My partner has to re-apply for her job under the current cut-backs. 19 months ago she had an operation that resulted in 6 months recuperation and a phased return to work. During her recent interview, the employer told her that her score for sickness was 0 (out of 30) which puts her at a great disadvantage. Is this lawful?

If the operation cured the problem then logically it should not count against future planning. Unfortunately employers having to rationalise staff tend to use certain criteria to make decisions. I hope your partner is successful in her application.
