Does my manager get a tip cut in my valet job?
I work for a valet company in Dallas, TX making 2.13/ hr plus tips. My manager (on salary) sometimes fills in for valet positions (usually when he knows the tips will be good.) At the end of the shift, he expects to be in on the tip split. Is this against the law due to the fact that he is making a salary while the valets are making 2.13 an hour? Thank you.

When an employer uses a tip pool to pay out non-tipped employees, or when they take tips for themselves, they are in violation of the federal Fair Labor Standards Act (FSLA). So, yes, it is against the law, and should be reported to the Texas Workforce Commission.
