SR22 Suspension and Police Academy?
For the record I have not been pulled over myself since 2004, I have been in the car before when we have been stopped. March 22, 2011 was one of 3 other times I was forced to show ID or everyone in the car was going to jail which is the reason I done it in the first place. I have not been in any accidents at all, I have no speeding tickets either. I just recently found out I can not attend the NTCC Police Academy which starts August 27th, 2012 due to a ticket I got on March 22, 2011. I was not the driver of the vehicle but I was the only one with an ID at the time so the ticket was giving to me. When I went to the municipal courts the clerk told me I had to pay the ticket because it was in my name and It did not matter if I was driving or not. So I end up paying the ticket, well I did not think anything of it because she told me if I paid it in full there will be no surcharges. I assume she did not inform me correctly because my lawyer said that was not true. Well 4 days ago I get a letter saying I owe surcharges from 05/14/2011 and 05/14/2012, so I went to the DPS office in my town. I was told I could not get my license renewed because of a SR-22 Suspension, I ask what it was for and she told me it was for the ticket I got on March 22, 2011. I told her what happen and she said to see a lawyer. I set a appoint up for a lawyer and he tells me I was not responsible for the ticket and I should not have paid it at all because that was an omission of guilt. I told them what they told me and I even had my wife confirm it since she was with me when I paid it. He told me that she was wrong to tell me that and that I could have fought it right then. Now I have to request a hearing to review my case and hire a lawyer to fight the case or just wait till the suspension is lifted. What I wanted to know is do I need a valid drivers license to study criminal justice. I have looked everywhere and so for it seems otherwise but I am not sure. They have a criminal justice course at my college but it requires the permission from the Police Academy instructor who is also over criminal justice. I would like to go to just go to the police academy but I know it might not be possible until next year which really disappoints me. Also it was my brother that was driving, we went to get ice and he just happens to forget his driver’s license that day. He is also going to the police academy but just wanted to go at the same time as me. The main reason I am concerned is that it makes my driving history look bad which is not true. 7 years passed before anyone got pulled over, I do understand that police officers need a good driving record. My lawyer told me that the best thing to do is fight it because I was not driving and my instructor also believes I should fight it as well. I am a good driver and follow the law to the T, everyone forgets their ID sometimes its just part of being human. I do not blame my brother for getting a ticket for him at all. I plan on fighting this when my hearing comes up and I would like to get my record cleared up. There are traffic citations o Also my lawyers exact words " By paying this ticket, you shot yourself in the foot! That was the cause of the SR-22 Suspension. You plead guilty for something you did not do, the ticket itself is not the problem. You paying the ticket was the problem." Basically my understanding is for some reason or another my license was suspended 2 weeks after paying the ticket which I have documents to prove that since I got them from the DPS office. Not being pulled over in 7 years and having all tickets and surcharges paid in full prior to receiving the ticket does not make any sense to me at all. I am still waiting on my driving records in the mail but it seems there are 4 total citations within a 12 month period. That’s not possible since I have not been pulled over or received any warrants or anything at all other then the letter I got for surcharges for the March 22, 2011 ticket. I can not say why this happen, all I can do is go to court to try and fix it.
