Can an employer and or the company that does the criminal background checks legally deny you a job...?

because you were falsely arrested and charged with a crime, you NEVER pleaded guilty and you NEVER were found guilty of this crime, but took a "deal" (sort to speak, to end the endless court appearances for something so stupid that was a lie to begin with) if no similars in a year, it will go completely off your record and or be dropped??? Never spoke to a judge about this so-called "deal", that is how dumb and petty this all was. Yeah sounds like it is not accurate, but this is exactly what happened. More importantly, I am wondering why a criminal background check company would put a "fail" because of a charge and there was no conviction? FYI: The company(ies) that put a fail for the criminal background check is USIS, CBCU, and Hireright. If you need to put "probably" in your response, you need not to respond, cause that means you don't really know. Don't tell me what you have never heard of, all of this is exactly what happened.
