Is this discrimination?

I work for a temp agency. I was contracte to do manual labor for 10/hr. I was moved to the shipping department, then to the office as a buyer/ planner. Now I'm doing a customer service representative job with the same company. My title has never changed from a material handler to anything else. And all of these positions are supposed to pay more on the hour. I called the board of labor and they say I am supposed to be paid for the job I am doing no matter what it is. I know there are different pay rates because a fellow temp changed roles to a different department an they adjusted her pay accordingly. The company knows that I am capable of doing the hard jobs that require brain smarts so they are making me so so. Yet I'm being paid for a manual labor job. The last person in te role I am currently in was paid 4 dollars more on the hour. Are they discriminating against me for being a temp?

No, not a case of discrimination and being a temporary agency employee is not a status that is protected under any discrimination laws either. You work for the temp agency. You are not an employee of the company that contracts with the temp agency. You report your hours worked to the temp agency and you get your... More

That actually might be discrimination, seeing as they don't pay you appropriately for the job. Why don't you check with your manager or boss and tell them your situation, explaining why you think you should get a more appropriate pay.
